1. Scope and Applicability

These Terms and Conditions (“T&Cs”) govern the use of the services and digital platform provided by TMA Network GmbH, located at Moosweg 8, 85570 Ottenhofen, Germany (“TMA Network,” “we,” “our,” or “us”).

They apply to all network members, registered users, and business partners (“you” or “the user”).

By accessing or using our website or services, you agree to be bound by these T&Cs.

2. Services Provided

TMA Network facilitates the development and coordination of a global network of logistics and forwarding companies. Our services include (but are not limited to):

• Onboarding and management of member companies
• Providing tools for digital shipment coordination, tracking, pricing, and booking
• Supporting communication and relationship building between members
• Organizing physical and digital conferences, workshops, and member meetings
• Sharing of industry insights, best practices, and innovations
• Enabling strategic cooperation and contract facilitation between members

TMA Network does not act as a freight forwarder or carrier and assumes no liability for shipments conducted by network members.

3. Membership and Access

• Access to certain areas of the platform is restricted to registered network members.
• Membership requires approval by TMA Network and is governed by a separate membership agreement.
• TMA Network reserves the right to deny or revoke membership or platform access in case of misuse, breach of terms, or reputational risks.

4. User Obligations

Users agree to:

• Provide accurate and up-to-date information during registration
• Use the platform and tools only for lawful and professional purposes
• Respect confidentiality of all network communications and documents
• Not share access credentials or sensitive content with third parties

Unlawful use or unauthorized access may result in immediate termination.

5. Intellectual Property

All content, software, designs, trademarks, and data made available on this platform are the property of TMA Network or its licensors and may not be copied, altered, or redistributed without explicit permission.

6. Liability

TMA Network is not liable for:

• Direct or indirect damages resulting from the use of the platform
• Content or actions of other network members
• Downtime, data loss, or technical issues beyond our control

Our liability is limited to intent and gross negligence and is subject to mandatory statutory provisions.

7. Confidentiality

All communication and documents exchanged within the network are confidential and must not be disclosed to third parties without prior written consent. This obligation survives termination of membership.

8. Termination

Each party may terminate the cooperation with due notice in accordance with the membership agreement. TMA Network reserves the right to deactivate accounts in cases of non-compliance or misuse.

9. Data Protection

TMA Network processes personal data in accordance with the applicable data protection laws and our [Privacy Policy].

10. Governing Law and Jurisdiction

These T&Cs are governed by the laws of the Federal Republic of Germany.

Place of jurisdiction shall be Munich, unless otherwise stipulated by mandatory law.

11. Amendments

TMA Network reserves the right to amend these T&Cs at any time. The current version will always be published on our website. Users will be informed of significant changes in advance.
